Oscar Feldenkreis is named in a lawsuit, alleging that he banned African Americans and gay individuals from the brand’s ads as well as subjecting employees to “highly offensive homophobic, racial and thnic slurs, in violation of federal law. According to The Fashion Law, the lawsuit goes on to say that Feldenkreis created a hostile work environment.
Joseph Cook, the senior executive who filed the lawsuit against Perry Ellis, claims that the homophobic and racist policy dates back to 2013, when Feldenkreis was reviewing an ad with Lord & Taylor and stated that the company had a preference for “no black or gay people.” Cook is also claiming that since bringing up these issues, he has been cut out of all decision-making, and he is seeking damages “including and not limited to compensation for Cook’s mental anguish, humiliation, embarrassment, stress and emotional pain and suffering.”
Perry Ellis has denied all the claims, and released a statement.
“Perry Ellis is a company that promotes equal opportunity and a positive working environment. The company is proud of the face that it is probably one of the most diverse companies in the apparel business following its multicultural roots, stemming from Puerto Rico and Cuba. The claims asserted will be vigorously defended against.”
